The return of consigned assets to the right holders requires a motivated decision from the Consignment Office. In the event of a consignment on the basis of article 1 (1) of the 29 April 1999 law on consignments to the State, the return occurs in accordance with the act which authorizes it. In the event of a consignment on the basis of article 1 (2) of the aforementioned law, the return occurs on a duly justified request.
The return relates either to assets consigned in kind, or to the amounts acquired instead of the assets initially consigned. Subject to article 5 (5) of the 29 April 1999 law on consignments to the State, it also relates to the proceeds and products of these assets and sums, as established by the Consignment Office. The Consignment Office is not required to transfer these proceeds and products before the end of the consignment.
The Consignment Office can only return the consigned assets after receiving payment of the remaining due charges from the right holder to the benefit of the Treasury.
